About the Indiana Department of Insurance (IDOI): The purpose of the Indiana Department of Insurance is to protect Hoosiers as they purchase and use insurance products to keep their assets and their families from loss or harm. Consumers may need assistance with certain claim situations or just help in understanding how their policies work. Our other primary obligation is to monitor the financial solvency of the insurance companies domiciled in Indiana so that the legal promises made in insurance policies are honored. To these ends, our Department staff is committed to providing exceptional customer service for both our consumers and our companies, and to maintain a fair and objective viewpoint as we examine each issue and circumstance within our jurisdiction. Role Overview: The Legal Division provides overall legal support to all divisions of the Department of Insurance. The range of legal problems is wide and varied, from the applicability of insurance law to internal personnel issues. In addition, the legal division reviews all petitions for excess damages filed against the Patient's Compensation Fund. It is our goal to thoroughly review, analyze, and evaluate each petition; to treat each plaintiff with respect; and to obtain results that are legally correct, fair, and reasonable. The General Counsel provides complete legal guidance to the Commissioner of Insurance and employees of the Indiana Department of Insurance in areas such as insurance law, the Affordable Care Act, medical malpractice, admininstrative law, personnel matters, Indiana's Access to Public Records Act, Indiana's Administrative Orders and Procedures Act, and Indiana's ethics code; and to oversee all legal tasks at the Department. Salary Statement: The salary for this position traditionally starts at $102,024.00 but may be commensurate with education or work experience. Essential Duties/Responsibilties: + The General Counsel must have an unlimited license to practice law in Indiana and an advanced understanding of insurance and medical malpractice law and must be able to to interpret and enforce Title 27 of Indiana Code + Oversee and manage performance of the IDOI Legal Division - General Counsel will clearly define and communicate roles and responsibilities as directed by the Commissioner + Provide legal advice to the Insurance Commissioner regarding insurance and other Indiana law and applicable federal and other state laws + Build strong relationships with customers, stay aware of customer needs, concerns, and satisfaction; respond promptly to customer questions and requests, and effectively manages customer expectations. internal customers include the Commissioner and IDOI team members, and external customers include consumer groups, other state and federal regulators, legislators, Patient's Compensation Fund (PCF) qualified providers, and the insurance industry + Advise Department personnel on compliance with the NAIC Market Regulation standards and examination statute + Effectively manage and direct independent examination teams on examination procedures, reviews and Department interpretation of applicable laws and regulations + Monitor companies' compliance with orders and corrective action plans arising out of a market conduct examination or other regulatory settlement agreement + Monitor and participate on assigned NAIC task forces and committees + Research and analyze legal issues; + Respond to questions from other state agencies, legislative services agency, the public and the insurance industry regarding Indiana insurance laws, regulations and bulletins. + Present evidence or preside over Rule hearings. + Serve as an administrative law judge or advise the administrative law judge during administrative hearings; + Advise the final authority on matters involving final administrative orders + Confer with and provide counsel to the Office of the Attorney General concerning litigation strategy, including developing recommendations regarding potential impact of litigation of a case + Assist with drafting proposed legislation + Ensure that contracts are prepared in accordance with IDOA, SBA, and AG policy + Draft and/or review memoranda of understanding and other legal documents + Assist in the drafting and promulgation of administrative rules + Speak to consumer and industry groups about insurance issues + Represent the Department at legislative hearings + Monitor all legislation affecting the Department + Ensure that appropriate measures are taken to comply with new legislation passed each year + Interact with other state agencies regarding legislative initiatives + Serve as proxy attendee to National Association of Insurance Commissioners functions, legislative hearings, and other meetings + Other duties as assigned Job Requirements: + Graduate degree in law; admission to Indiana State Bar; and significant experience in the legal field; + Thorough knowledge of and ability to interpret and apply state and federal laws’ rules and regulations specifically those applying to insurance and medical malpractice; + Ability to communicate effectively verbally and in writing; + Organizational ability to formulate and carry out litigation strategies and initiate policies; + Presentational skills with ability to persuade; + Thorough knowledge of and ability to apply all requirements established by governing bodies; + Ability to research and evaluate legal precedents; + Participation in continuing legal education programs; + Ability to apply legal principles; + Ability to analyze complex problems and make sound resolutions of problems; + Ability to tactfully communicate with a wide variety of professionals and involved involved to resolve disputes. Supervisory Responsibilities/Direct Reports: This role provides direct supervision for two or more attorneys.
