MAIN PURPOSE OF JOBTo lead and manage our Commercial Legal, IP, Legal Tech and Data Protection initiatives and resources across the MEA and Swiss regions. To play a pivotal role in guiding legal strategy, contributing to the delivery of world-class legal services and supporting the growth and success of Mediclinic in the MEA and Swiss Regions.
KEY RESPONSIBILITY AREAS Lead the Commercial Legal, IP and Legal Tech work streams by overseeing and coordinating the related activities across the MEA and Swiss regions, to ensure alignment with Group strategy. Provide strategic legal counsel and lead the commercial legal strategy by developing strategies that align with the organisation's goals and international operations. Promote best practices by developing, and standardising legal processes and ensuring that legal processes are efficient, compliant and aligned with the organisation's goals. Lead contract management by providing strategic legal guidance and overseeing the drafting, negotiation, and review of complex international contracts, agreements, and transactions to ensure that contracts are legally sound and protect the organisation's interests. Data Protection Management by ensuring effective data protection advisory services to the organisation. Cost management by controlling legal costs in accordance with the budget, associated with commercial legal, IP and Legal Tech to maximize the efficiency of the in-house legal team, leverage technology and oversee the effective use of external counsel. Oversee the training and development of the in-house Legal teams and Data Protection teams to ensure that they are equipped with the necessary knowledge and skills to support the organisation effectively. Conduct research and analysis to stay informed of legal developments to ensure compliance with the laws and regulations of the different geographies and be able to advise on potential impacts on the organisation’s operations. Manage the Legal Tech integration by driving the implementation and adoption of legal technology tools to enhance the efficiency, effectiveness and accuracy of work within the organisation’s legal function. REQUIRED EXPERIENCEESSENTIAL MINIMUM EXPERIENCE
Minimum of 12 years post-qualification experience, with at least 5 years at a commercial law firm. Extensive experience in reviewing, drafting, and negotiating commercial contracts. In-depth knowledge of IP law, including patents, trademarks, and copyright.DESIRED EXPERIENCE
Knowledge of the healthcare industry is advantageous. REQUIRED JOB SKILLS AND KNOWLEDGE Extensive experience of commercial and IP law; with ability to manage complex legal issues Expertise in drafting, negotiating and interpreting a wide range of complex commercial agreements including technology agreements Prior experience of managing an international IP portfolio licensing and protection of IP assets including extensive experience of enforcement action. Commitment to high ethical standards and an understanding of the ethical implications of legal decisions Strong analytical and problem-solving skills to assess legal issues, identify potential solutions, and make informed decisions Knowledge of corporate governance practices and principles applicable to healthcare organisations, including compliance with corporate policies A solid grasp of business principles in an international context, market dynamics, and industry trends to provide strategic legal advice that aligns with business goalsAll applicants will be considered, with the understanding that preference will be given in accordance with the Employment Equity Plan of Mediclinic Group Services, as well as internal applicants/employees that meet the minimum requirements.
